General Terms and Conditions

Article 1 — Definitions
In these terms and conditions, the following definitions apply:
- “BadCat Furniture” refers to the sole trader operating the webshop at badcatfurniture.nl and the Etsy shop BadCatBDSMFurniture, based in the Netherlands.
- “Customer” refers to any natural person or legal entity placing an order through the webshop or Etsy store.
- “Order” refers to any purchase of a product or custom commission placed by the Customer.
- “Product” refers to any item offered for sale, including custom-made furniture, stocks, cuffs, and accessories.
Article 2 — Applicability
These terms and conditions apply to all offers, orders, and agreements between BadCat Furniture and the Customer. By placing an order, the Customer accepts these terms in full.
BadCat Furniture reserves the right to amend these terms at any time. The version in effect at the time of the order applies.
Article 3 — Orders and Custom Work
All products are handmade to order and custom-built to the Customer’s specifications and measurements. An order is confirmed once payment has been received in full.
Because every item is made to measure, the Customer is responsible for providing accurate measurements. Once production has begun, measurements cannot be adjusted. BadCat Furniture cannot be held liable for items that do not fit due to incorrect measurements supplied by the Customer.
BadCat Furniture reserves the right to decline orders at its discretion, for example if a commission falls outside the scope of what is offered.
Article 4 — Prices and Payment
All prices shown are exclusive VAT. Shipping costs and VAT are calculated separately at checkout based on destination and package dimensions.
Payment is required in full before production begins. BadCat Furniture accepts payment through the methods offered at checkout. Orders are not entered into production until payment is confirmed.
Article 5 — Production Time
As all items are handmade and custom-built, production typically takes between 2 weeks and 2 months from the date of confirmed payment. This timeframe depends on the complexity of the item and current workshop capacity.
BadCat Furniture will communicate expected timelines to the Customer but cannot guarantee fixed delivery dates. Delays in production do not give the Customer the right to cancel an order or claim compensation unless the delay is unreasonably long.
Article 6 — Shipping
BadCat Furniture ships internationally. Shipping costs are calculated live at checkout and are not marked up — the Customer pays the actual carrier rate.
Shipments within the EU typically arrive within 2 to 5 business days. Shipments outside the EU typically arrive within 4 to 8 business days. These are estimates and not guarantees.
BadCat Furniture ships to non-EU destinations using Delivered Duty Paid (DDP) terms. This means all applicable import duties and taxes are prepaid. The Customer will not receive additional duty or customs invoices upon delivery.
Once a package has been handed over to the carrier, BadCat Furniture is not responsible for delays caused by customs, carrier handling, or circumstances outside its control. However, BadCat Furniture will assist the Customer in resolving shipping issues where reasonably possible.
Article 7 — Right of Withdrawal
Because all products are custom-made to the Customer’s specific measurements and requirements, they are exempt from the standard 14-day right of withdrawal under EU consumer law (Article 16(c) of Directive 2011/83/EU).
Orders cannot be cancelled once production has begun. If production has not yet started, cancellation requests may be considered at BadCat Furniture’s discretion, and a partial refund may apply depending on any materials already purchased.
Article 8 — Guarantee
BadCat Furniture stands behind the quality of its work. Products are guaranteed against defects in materials and craftsmanship under normal use for the lifetime of the product.
“Normal use” means use consistent with the intended purpose of the product as described in the shop listing.
In the event of a covered defect, BadCat Furniture will repair or replace the item. Return shipping costs will be shared equally between BadCat Furniture and the Customer.
The guarantee does not cover damage resulting from misuse, excessive force, improper storage, accidents, or modifications made by the Customer.
Article 9 — Liability and Disclaimer
BadCat Furniture’s products are designed for adult consensual use. By placing an order, the Customer confirms they are 18 years of age or older and that all persons who will use or be restrained by the product are consenting adults.
BadCat Furniture is not responsible for any injuries, harm, or damage — to persons or property — resulting from the use of its products. The Customer assumes full responsibility for safe and responsible use.
The Customer is expected to practice safe, sane, and consensual play at all times. This includes but is not limited to: never leaving a restrained person unattended, always ensuring the restrained person has a means to signal distress, and not exceeding the physical limits of the product or the persons involved.
BadCat Furniture’s total liability for any claim arising from an order shall not exceed the purchase price paid for the product in question.
Article 10 — Privacy
BadCat Furniture processes personal data (name, address, email, order details, and measurements) solely for the purpose of fulfilling orders and communicating with the Customer. Data is not sold to or shared with third parties, except where required by law or necessary to fulfil shipping (e.g. passing an address to a carrier).
The Customer has the right to access, correct, or request deletion of their personal data. Requests can be sent to mail@badcatfurniture.nl.
BadCat Furniture complies with the General Data Protection Regulation (GDPR).
Article 11 — Disputes and Applicable Law
These terms and conditions are governed by Dutch law. Any disputes arising from an order or agreement shall be submitted to the competent court in the Netherlands.
BadCat Furniture will always attempt to resolve disputes amicably before legal proceedings are initiated. Customers are encouraged to contact BadCat Furniture directly at mail@badcatfurniture.nl in the first instance.
